📄 1. Introduction

1.1 This agreement is between you and Madormo Group Pty Ltd ABN 826 587 428 88, trading as Restmaker ("Restmaker", "us", "we", or "our"), located at Unit 21, 70 Bridge Street, Picton NSW 2571, Australia.

1.2 These Terms & Conditions govern your use of Restmaker's ordering and delivery services ("the Services") via our website www.restmaker.au ("the Site") or our telephone ordering service.

1.3 By creating an account and using our Services, you accept these terms, which may be updated periodically.

1.4 We may revise these terms from time to time. Your continued use of the Services after any update means you accept the revised terms.

1.5 Any additional conditions on other pages of the Site (such as product information pages) are incorporated into this agreement unless they conflict with these terms.

⚙️ 2. Service Usage

2.1 You agree to use the Site and Services only for lawful purposes permitted by this agreement.

2.2 You must not access the Site by any means other than the interface we provide.

2.3 You must not interfere with or disrupt the operation of the Site or Services.

2.4 You may not use another member's account without their permission.

2.5 We reserve the right to suspend or terminate your account if we reasonably suspect fraudulent activity or conduct inconsistent with these terms.

👤 3. Account Creation

3.1 To use our Services, you'll need to create an account and provide accurate personal details.

3.2 You must not use false or misleading information when creating an account.

3.3 If your details change, update them before placing your next order.

3.4 We are not responsible for any issues arising from inaccurate or incomplete information you provide.

⚖️ 4. Legal Capacity

You must be 18 years of age or older and legally capable of entering binding contracts to use our Services.

🛒 5. Ordering

5.1 You can place orders for products displayed on the Site via the Services.

5.2 Items displayed on the Site do not constitute a commitment to sell. By placing an order, you are making an offer to purchase under these terms at the displayed price.

5.3 We reserve the right to accept or reject any order, including due to pricing errors, product unavailability, or suspected fraud.

5.4 A binding contract of sale is formed only once we accept your order. If we agree to cancel a confirmed order, a minimum $30 administration fee plus any storage, labour, and shipping costs incurred will be charged before any refund is processed.

5.5 Promotional codes can only be applied at the time of ordering and cannot be applied retroactively. Only one code may be used per order. Codes have no cash value, cannot be combined with other offers (unless stated), and are only valid during the promotional period.

5.6 For high-value or potentially fraudulent orders, we may request additional verification. We reserve the right to cancel any order we reasonably suspect is fraudulent.

💰 6. Pricing & GST

6.1 All prices are in Australian dollars (AUD) and include GST.

6.2 Displayed prices do not include delivery charges unless specifically stated.

6.3 We reserve the right to update prices at any time.

💳 7. Payment

7.1 You must pay the full purchase price, including any applicable delivery charges.

7.2 We accept Visa, Mastercard, PayPal, Afterpay, Zip Pay, and direct bank transfer.

7.3 Your order will not be processed until full payment is received. Bank transfer payments may take several business days to clear.

🚚 8. Delivery

8.1 We will deliver your order to the address provided at checkout once full payment is received.

8.2 Estimated delivery dates are provided as a guide only — they are not guaranteed.

8.3 Standard delivery is a door-to-door service to the ground floor. It does not include assembly, installation, or removal of existing items.

8.4 If you provide an Authority to Leave, delivery will proceed unattended, and risk passes to you at that point.

8.5 We are not responsible for redelivery costs caused by your unavailability or an incorrect delivery address.

8.6 If uncollected items remain at our warehouse for more than 14 days, we reserve the right to dispose of or sell them, refunding proceeds less a $5/day storage fee, a $40 admin fee, and any delivery costs.

8.7 We currently deliver to Sydney Metro, select surrounding Sydney regions, and select ACT locations only. Interstate delivery is not currently available. We do not deliver on weekends or public holidays.

8.8 Orders can only be cancelled by telephone during business hours on 0415 684 206. Cancellation fees apply as follows:

• 🛑 Order processing but not yet dispatched: $30 cancellation fee
• 🔄 Order already dispatched: Outbound shipping plus equivalent return shipping fee

🔒 9. Risk & Ownership

9.1 Ownership of goods passes to you only when full payment is received.

9.2 Risk passes to you upon delivery (or upon Authority to Leave, if applicable).

🛡️ 10. Warranties

10.1 Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage.

10.2 Additional warranty periods are listed on individual product pages and in our Warranty Information page.

10.3 To make a warranty claim, notify us in writing with proof of purchase:

10.4 Upon receipt of your claim, we'll assess it and provide a resolution as outlined in our Warranty Information page.

10.5 Return items to us in their original packaging, clearly labelled with your return authorisation number. We are not responsible for damage during return transit.

⚠️ 11. Warranty Exclusions

To the extent permitted by law, warranties do not apply where products have been subject to:

• ❌ Misuse, abuse, neglect, or accident
• ❌ Unauthorised alteration or modification
• ❌ Non-compliance with care and maintenance instructions
• ❌ Normal wear and tear or expected fading/discolouration
• ❌ Use in commercial settings (e.g., hotels, gyms, accommodation)

🛏️ 12. 100-Night Trial — Mattresses

12.1 All Restmaker mattresses come with a 100-Night Trial. If for any reason you're not satisfied with your mattress, you may return it within 100 nights of delivery for a full refund of the mattress purchase price, subject to the conditions below.

12.2 To be eligible for the 100-Night Trial, you must:

• ✅ Have purchased the mattress directly from restmaker.au
• ✅ Have used a mattress protector throughout the trial period
• ✅ Sleep on the mattress for a minimum of 21 nights before requesting a return
• ✅ Contact us at [email protected] or call 0415 684 206 before the end of night 100
• ✅ Ensure the mattress is in reasonable, hygienic condition — free from stains, soiling, tears, or damage

12.3 The 100-Night Trial:

• 🔹 Applies to mattresses only. It does not apply to bed frames, bases, accessories, or clearance items.
• 🔹 Is limited to one mattress per household
• 🔹 Does not include the original delivery fee, which is non-refundable
• 🔹 Applies to purchases made directly through restmaker.au only

12.4 Once your return request is accepted, we will arrange free pickup. Refunds are processed within 7 business days of the mattress being collected and inspected.

🔄 13. 30-Day Returns — Other Products

13.1 For all products other than mattresses, we offer a 30-day change of mind return from the date of delivery.

13.2 To be eligible, you must:

• 📋 Contact us within 30 days of delivery at [email protected], including photos of the item in its original packaging
• 📦 Return the item in original, unused condition in original packaging
• 🚚 Pay return shipping costs
• 🔢 Accept that a 10% restocking fee will be deducted from your refund

13.5 All returns must be sent to: Restmaker, Returns Department, Unit 21, 70 Bridge Street, Picton NSW 2571, with your Return Authorisation (RA) number clearly visible.

13.6 Refunds are processed within 7 business days of receiving the returned item.

📋 14. Transit Insurance

14.1 All orders include complimentary transit insurance.

14.2 If your item arrives damaged, notify us within 24 hours of delivery with photos of the damage and packaging, along with your delivery docket.

14.3 If we determine the item was damaged in transit, we'll arrange a repair, replacement, or refund at our discretion.

14.4 If you signed for delivery without noting damage on the delivery docket, we reserve the right to decline a transit damage claim.

🛑 15. Limitation of Liability

15.1 We are not liable for any loss or damage arising from your use of the Services or the sale of any product, beyond the amount you paid for that product.

15.2 We are not liable for any loss resulting from unauthorised or fraudulent use of your payment method.

15.3 We are not liable for any loss arising from your provision of an Authority to Leave.

15.4 You agree to indemnify us against any third-party claims arising from your breach of these terms or your negligence.

🔒 16. Privacy

We are committed to protecting your privacy and comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our full Privacy Policy at restmaker.au/privacy-policy.

✨ 17. Intellectual Property

17.1 All intellectual property rights in the Site and its content are owned by or licensed to Restmaker. You may not reproduce, distribute, or use any content from the Site without our prior written consent.

17.2 We grant you a limited, non-exclusive, non-transferable licence to use the Site for personal, non-commercial purposes only.

🎁 18. Competitions

18.1 Winners of competitions are selected at random and notified by email within two weeks of the competition end date.

18.2 Competitions are open to Australian residents aged 18 and over. Prizes are awarded as gift cards or store credit redeemable on the Restmaker website (restmaker.au) only. Prizes cannot be exchanged for cash. Restmaker reserves the right to cancel or modify any competition at any time.

🌐 19. General

19.1 We are not liable for delays caused by circumstances beyond our reasonable control.

19.2 If any part of these terms is found to be invalid or unenforceable, it will be severed from the rest. The remaining terms continue in full force.

19.3 These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
